In a move that has become increasingly rare among her Congressional colleagues, Senator Barbara Boxer (D-CA) took public her call for the removal of Environmental Protection Agency Administrator Stephen Johnson if he continues stonewalling Congress, saying,

"Today, I am announcing a number of actions.
1) I am asking EPA Administrator Stephen Johnson to release every document related to the Agency's finding that global warming poses a danger to the public, including bringing the endangerment e-mail back to earth.
2) EPA s hould also immediately release a strong advance notice of proposed rulemaking on global warming emissions.If Mr. Johnson refuses to do these two things -- if he does not have the strength to do them -- he should resign. The American people need the head of the EPA to be an independent advocate for their health and their environment."

Supreme Court to EPA: Regulate Green House Gases

In a ground-breaking 5-4 decision the Supreme Court ruled today that the Environmental Protection Agency has the power to regulate the polluting emissions of carbon dioxide and other greenhouse gases from vehicles. The decision moves Bush administration further along the path from its former position of complete and aggressive denial of global warming to tepid acknowledgment, now forcing the Bush administration to recognize and regulate carbon dioxide as a pollutant under the Clean Air Act. The court's decision underscores the reality of human activities contributing to global warming.

The Bush Administration had argued that the EPA had no authority to regulate motor vehicle admissions under the Clean Air Act. The Supreme Court’s decision also throws into question the Bush Administration’s rejection of the Kyoto Protocol, further embarrassing the Bush Administration in the world community.

(Chicago Tribune) Supermarkets throughout the Chicago area are routinely selling seafood highly contaminated with mercury, a toxic metal that can cause learning disabilities in children and neurological problems in adults, a Tribune investigation has found.

In one of the nation's most comprehensive studies of mercury in commercial fish, testing by the newspaper showed that a variety of popular seafood was so tainted that federal regulators could confiscate the fish for violating food safety rules.

Groups Seek Tougher EPA Rules on Mercury
Some of the nation's top environmental groups said Tues. they will join the efforts of at least 13 states hoping to force industry to install mercury pollution controls tougher than those imposed this spring by (Bush's) EPA. Attorney generals from at least 13 states, led by New Jersey, challenged the rules in a lawsuit filed in U.S. District court in Washington. The Sierra Club, National Wildlife Federation and Environmental Defense said they will file a separate legal challenge on Wed. The Clean Air Task Force, representing the U.S. Public Research Interest Group, Natural Resources Council of Maine and the Ohio Environmental Council said it would file another lawsuit. The Waterkeeper Alliance, Chesapeake Bay Foundation, and Conservation Law Foundation planned a third legal action. And the Natural Resources Defense Council said it would file its own challenge...

EPA Abandons Rule on Lead Poisoning from Home Renovations

Monday, May 09, 2005 -- Rep. Waxman, Sens. Boxer and Obama, and Reps. Towns and Lynch protest EPA's abandonment of regulations required by law to protect children from exposure to lead in renovated homes.

The Toxic Substances Control Act requires EPA to set national standards for lead-safe renovation and remodeling practices. These regulations would protect children, their families, and construction workers from one of the largest sources of exposure to lead. Although EPA has avoided making a formal announcement of its decision, the agency has apparently decided to forego issuing these regulations. Instead, EPA plans to ask the construction industry involved in home renovation and remodeling to voluntarily implement protective practices. EPA’s actions do not comply with the law, and they utterly fail to protect our children from a toxic substance that can cause severe developmental damage.

AP report: "An internal Environmental Protection Agency report estimates the Southeast alone could reap up to $2 billion a year in benefits from reducing mercury pollution - far greater than the $50 million in benefits the agency projected publicly for the entire nation. Critics said the report shows the Bush administration sought to minimize the benefits of reducing mercury pollution in order to justify not requiring power plant owners to buy the most effective technology for lowering mercury emissions. "EPA has a track record of withholding information that doesn't support their agenda, and this is the latest example," said Felice Stadler, a National Wildlife Federation policy specialist....

EPA Cancels Proposed Study That Would Have Exposed Children To Pesticides

(AP) - The Environmental Protection Agency on Friday canceled a controversial study using children to measure the effect of pesticides after Democrats said they would block Senate confirmation of the agency's new head.

Stephen Johnson, as EPA's acting administrator, ordered an end to the planned study, a reversal from the agency's position just a day earlier when it said it would await the advice of outside scientific experts.

The aim of the study, Johnson said, was to fill data gaps on children's exposure to household pesticides and chemicals. He suspended it last November after ethical questions were raised by scientists within EPA and by environmentalists.
